TERMS OF SERVICE

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and PatterNest ("PatterNest," "we," "us," or "our"), governing your access to and use of www.cradleglow.store (the "Site") and any purchase made through it. By accessing the Site or placing an order, you accept these Terms in full. If you do not agree, you must discontinue use of the Site immediately.
1. Eligibility
You must be at least 18 years of age and legally capable of entering into a binding contract to use the Site or place an order. By placing an order, you represent and warrant that you meet these requirements. PatterNest reserves the right to refuse service to anyone at its sole discretion.
2. Products and Order Acceptance
All product descriptions, images, and pricing on the Site are subject to change without notice. PatterNest reserves the right, at any time and without liability, to:
a) limit or refuse the quantity of any order; b) refuse or cancel any order for any reason, including suspected fraud, pricing or listing errors, or unauthorized/illegal activity; and c) discontinue any product at any time.
Placing an order does not guarantee acceptance. A contract of sale is formed only upon PatterNest's shipment confirmation, not upon order placement or payment authorization. If PatterNest cancels an order after payment has been captured, the sole remedy available to Customer is a full refund of the amount paid for that order.
3. Pricing and Payment
All prices are listed in U.S. Dollars unless otherwise stated and do not include applicable taxes, duties, or import fees, which are the sole responsibility of Customer. In the event a product is listed at an incorrect price due to typographical, technical, or pricing error, PatterNest reserves the right to refuse or cancel any order placed at the incorrect price, whether or not the order has been confirmed and payment charged.
Payments are processed through third-party payment processors. PatterNest does not store full payment card details and is not responsible for any error, delay, or data incident occurring on the part of a third-party payment processor.
4. Shipping
Shipping timelines displayed on the Site are estimates only and are not guaranteed. As orders may be fulfilled from international supplier locations, delivery times may vary and are subject to customs processing outside PatterNest's control. Title and risk of loss for all products pass to Customer upon delivery to the shipping carrier. Shipping delays do not, by themselves, entitle Customer to a refund, order cancellation, or chargeback. Full terms governing returns and refunds are set out separately in our Return & Refund Policy, which is incorporated into these Terms by reference.
5. Intended Use and Product Safety Disclaimer
PatterNest products are designed for supervised use by a parent or caregiver only. No PatterNest product is a medical device, is intended to diagnose, treat, cure, or prevent any medical condition, or is designed or intended as an unsupervised sleep surface for an infant. Customer is solely responsible for:
a) reading and following all instructions, warnings, and age recommendations included with the product; b) never leaving a child unattended while using the product; and c) following applicable pediatric safe-sleep guidance for any period the child is sleeping unsupervised.
PatterNest disclaims all liability arising from any use of the product inconsistent with its included instructions or with this Section.
6. Intellectual Property
All content on the Site — including but not limited to the PatterNest name, logo, product photography, graphics, copy, and page layout — is the property of PatterNest or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without PatterNest's prior written consent.
7. User Submissions
By submitting a product review, photo, testimonial, comment, or other content ("Submission") to PatterNest through the Site, email, or social media, you grant PatterNest a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, display, and distribute that Submission in any marketing or promotional material, in any medium, without additional compensation or attribution. You represent that you own or have the right to submit the Submission and that it does not infringe any third party's rights.
8. Prohibited Conduct
You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to any portion of the Site or its underlying systems; (c) interfere with the Site's operation, including through automated scraping or bot activity; or (d) submit false, fraudulent, or abusive order or payment information.
9. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT WHERE SUCH DISCLAIMER IS PROHIBITED BY APPLICABLE LAW.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PATTERNEST'S TOTAL LIABILITY TO CUSTOMER FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR ANY ORDER SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY CUSTOMER FOR THE PRODUCT GIVING RISE TO THE CLAIM. IN NO EVENT SHALL PATTERNEST BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
11. Indemnification
You agree to indemnify, defend, and hold harmless PatterNest, its officers, employees, and agents from any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising out of or related to (a) your use or misuse of any product outside its intended use as described in Section 5, (b) your breach of these Terms, or (c) your violation of any applicable law or third-party right.
12. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or any order shall be resolved through binding individual arbitration, and not in court, except that either party may bring an individual claim in small-claims court. You and PatterNest each waive the right to a jury trial and the right to participate in a class, collective, or representative action. 13. Governing Law
These Terms are governed by the laws of [State to be inserted], without regard to its conflict-of-law principles.
14. Severability
If any provision of these Terms is held invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. Changes to These Terms
PatterNest reserves the right to modify these Terms at any time without prior notice. Continued use of the Site following any change constitutes acceptance of the revised Terms. The version in effect on the date an order is placed governs that order.
16. Entire Agreement
These Terms, together with our Return & Refund Policy and Privacy Policy, constitute the entire agreement between Customer and PatterNest with respect to the Site and supersede any prior agreements.
